At-Will Employment

It is important to understand the ins and outs of at-will employment. Employment relationships are presumed to be “at- will” in all U.S. states except Montana.

At-will means that an employer can terminate an employee at any time for any reason, except an illegal one, or for no reason without incurring legal liability.

Do not miss understand this does not mean it's a free-for-all when companies want to fire someone. The three major common at-will employment exceptions. They are;

  • Written contract

  • Implied contract

  • Implied covenant of good faith.
